Essential Qualifications

Option A: Professional Candidates

• Master's Degree in relevant field/subject OR technical qualifications like MBA or equivalent as specified in the TOR for the specialization/field.
• Minimum post qualification experience of 10 years in the requisite field.
• High competency and established peer reputation.

Option B: Retired Government Employees

• Retired Government Employees with Grade Pay of ₹ 5400/- / Level-10 (7th Pay Commission) and above.
• 10 years experience and knowledge of required domain field.

• Maximum age shall ordinarily be 65 years as on the closing date of receipt of applications (08 September 2026).

Remuneration & Benefits

• Remuneration: ₹ 90,000/- per month (all inclusive)
• Local Conveyance: As per equivalence prescribed (IDA pay scale of E-5 in NMDFC)
• Leave: 12 days leave in a calendar year on pro-rata basis
• TDS: Will be effected as per prevalent rules
• No Allowances: No DA, Residential phone, Transport facility, Residential accommodation, Personal staff, Medical reimbursement, Mobile expenses
• No TA/DA: For joining or on completion of assignment

Terms of Reference (TOR)

The Senior Legal Consultant shall be responsible for:

A. Brief Case History Preparation

• Prepare and maintain comprehensive Brief Case History for every case assigned to NMDFC.
• Include case title, number, court/tribunal name, date of filing, parties, background, core legal issues, relief claimed, hearing history, current status, next hearing date, risk assessment, and recommended strategy.

B. Recovery Mechanisms

• Filing and prosecution of Recovery Suits in appropriate courts/tribunals.
• Invocation of Government Guarantee provided by State Governments.
• Proceedings before DRT and DRAT.
• Proceedings under SARFAESI Act, 2002.
• Execution of decrees already passed in favour of NMDFC.
• Insolvency/winding-up proceedings under IBC, 2016.

C. Recovery Roadmap

• Prepare prioritised Recovery Roadmap identifying major defaulters, recommended legal route, estimated recovery potential, and suggested timelines.

D. Drafting of Legal Documents

• Legal Notices to defaulting NGOs/SCAs.
• Demand Notices under Section 138 of Negotiable Instruments Act.
• Letters to State Governments for invocation of Government Guarantees.
• Letters to statutory bodies (Registrar of Societies, NITI Aayog, MHA).
• Notices under SARFAESI Act, DRT Rules, etc.

E. Litigation Monitoring

• Act as nodal point for all litigation-related coordination.
• Prepare legal drafts (petitions, replies, written submissions, vakalatnamas).
• Attend court hearings.
• Maintain litigation calendar and track hearing dates.
• Submit reports and updated case summaries after each hearing.

F. Legal Advisory and Opinions

• Provide written legal opinions on contractual matters, service matters, statutory compliance, RTI matters, CVC/Vigilance matters, financial matters, labour law matters, and corporate/company law matters.

G. Vetting of Documents and Agreements

• Vetting of agreements, MOUs, contracts, circulars, notifications, and policy documents from a legal standpoint.

H. Drafting of Legal Documents

• Drafting written petitions, civil petitions, appeals, revisions, court/tribunal filings.
• Drafting replies, rejoinders, counter-affidavits, written statements.
• Drafting vakalatnamas, applications, and miscellaneous petitions.

I. Compliance and Regulatory Monitoring

• Monitor legal and regulatory developments relevant to NMDFC's operations.
• Submit monthly Compliance and Legal Update Note by the 5th of each month.
• Provide information requested by audit teams.
